Being an employer is more difficult than ever. Employers may not be able to curb their employees' remarks on social network sites. Employees have the right to discuss with each other their wages, hours of work and the conditions at work which could be of mutual aid and protection to them. Employers cannot stop such discussions and cannot fire anyone for making statements or engaging in such dialogue. This is a sacrosanct right. In a recent decision, a case decided that the right to engage in concerted activities applies to employees postings on their social networks. So, if an employee posts comments directed at other employees regarding conditions at work, call us before you fire the employee - he or she may have a protected speech.
